Can I be punished by my public school or employer for something I posted online?

I work for a city government and posted criticism of a local policy on my personal social media account. My supervisor says I could be disciplined. Is that allowed?

Public employees often have some free-speech protection that private employees may not, because the employer is the government. But it is not unlimited. Courts commonly weigh factors such as:

  • Whether you spoke as a private citizen or as part of your job duties.
  • Whether the topic is a matter of public concern.
  • Whether the speech seriously disrupted the workplace.

Keep a copy of the post and any communications about it, and get advice before responding to a disciplinary process.
