Mediation & ADR
What is the difference between mediation and arbitration?
A contract I signed says disputes go to “ADR.” I have a disagreement with a supplier and do not know whether that means mediation or arbitration, or what the difference is.

Both are alternatives to going to court, but they work very differently:
- Mediation — a neutral mediator helps the parties negotiate. The mediator does not decide; any settlement is voluntary.
- Arbitration — a neutral arbitrator hears both sides and makes a decision, usually binding and enforceable much like a court judgment, with limited grounds for appeal.
Read the dispute clause closely. It may require one, the other, or mediation first and arbitration if mediation fails, and may name a provider and rules.
