What debts are not wiped out by bankruptcy?

I am considering bankruptcy. Are there any debts that will still be there afterwards?

Yes. Bankruptcy discharges many unsecured debts, such as credit cards and medical bills, but some debts usually survive. Common examples include:

  • Child support and spousal support.
  • Most recent tax debts.
  • Most student loans, unless a court finds undue hardship.
  • Debts from fraud or certain injuries caused while intoxicated.
  • Criminal fines and restitution.

Secured debts are also different: the personal obligation may be discharged, but the lender can still take the collateral if you stop paying.
