Can a debt collector keep calling me after I file?

A collection agency calls me several times a day. If I file for bankruptcy, do the calls have to stop?

In many systems, filing triggers an “automatic stay,” which legally pauses most collection activity — calls, letters, lawsuits, wage garnishments and many foreclosures — as soon as the case is filed.

Give the collector your case number and your lawyer’s contact details. If collection continues after the creditor knows about the case, the court may be able to impose penalties.

There are exceptions, for example some family support obligations and repeat filings, so check how the stay applies to you.

This is general information, not legal advice — speak to a licensed lawyer about your situation.
