1. Hague Convention on the Civil Aspects of International Child Abduction. Both the U.S. and Canada are signatories. If your child was wrongfully removed from her habitual residence, you can file a Hague application through the U.S. Department of State.
2. New York custody petition (Family Court). NY can have jurisdiction under the UCCJEA if NY was the child’s home state in the 6 months before removal. Your local Family Court can issue temporary custody orders.
