Do I have to move out of the house before the divorce is final?

My spouse and I have agreed to divorce but we both still live in the house we own together. Things are tense but not unsafe. I have been told that leaving could hurt my case. Is that true?

In most places, simply moving out does not give up your ownership interest in a jointly owned home. The title and the eventual property division decide that, not who is sleeping there.

Where moving out can matter is with children. If you leave and the children stay, that arrangement can become the “status quo” a court looks at later. Many lawyers recommend agreeing a temporary parenting schedule in writing before anyone leaves.

Also keep paying your share of the mortgage and household bills unless you have a written agreement otherwise, and do not remove shared property without agreement.

One practical point: if the house is tense, ask a lawyer about a temporary order or a written interim agreement covering who stays, who pays what, and the children’s schedule. It reduces conflict and gives both of you certainty while the divorce is pending.
