Do I need a permit to fill in a wet area on my property?

There’s a soggy low area on my rural property that I want to level for a garden and shed. A neighbour said I might need a permit because it could be a wetland.

Your neighbour raises a valid point. Many jurisdictions regulate filling or draining wetlands and areas near streams, and the definition of a regulated wetland is technical — an area does not need standing water year-round to qualify. Rules may come from national, state or local law, and some areas are regulated at more than one level.

Before doing any work, consider contacting the local planning or environmental office and asking whether a wetland determination or permit is needed. A wetland consultant can assess the site.

Doing the work first and asking later can lead to orders to restore the area and potentially penalties, so it is usually cheaper to check in advance.
